TERMS & CONDITIONS
These terms and conditions (“Terms”) set out the terms and conditions governing your use of the App “Yummy” (“App” or “Service”) and any related products and services (collectively, “Services”).
These Terms are legally binding between you (“User” or “you”) and Albron BV, Rijnzathe 11, 3454 PV, De Meern (“Albron”).
Acceptance of these Terms
You acknowledge that you have read these Terms and agree to all terms. By accessing and using the App and Services, you agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to access or use the App and Services.
Accounts
If you create an account in the App, you are responsible for the security of your account and for any activity that occurs under the account. We may verify new accounts before you can sign in and start using the Services. Providing false contact information may result in the termination of your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
We may suspend, disable or delete your account (or any part of it) if we determine that you have violated any provision of these Terms or that your conduct or content could damage our reputation and goodwill. If we delete your account for the foregoing reasons, you will not be able to register for our Services again. We may block your email address to prevent further registration.
Purchases
You can order products via the App by placing the product in the digital shopping cart. You scan your products via the app or card, which ends up in the digital shopping cart. You can complete your order with an account and login for the relevant location. Before you pay for your lunch or other products, you can see your total order in the digital shopping cart. You can pay with the iDEAL payment system of your own bank. You must have a verified bank account installed on your mobile phone. You pay directly with your order. You can also pay via the PIN terminal. You can find the payment overview in the transaction history in the app. We monitor the correct use of scanning and payment via the App and may carry out checks to determine whether the scanning of all products and the payment is done correctly. This includes the use of an ICT system. An employee may ask you to show your purchase summary to see if you have scanned and paid for all products. We can report theft to the police.
Payment methods are possible via a third party. Payment for an order is made in a secure internet environment. Others cannot see into this. Transaction data is sent encrypted via an SSL connection.
Allergies
Products and dishes may contain traces of nuts, celery, cow's milk, egg, peanuts, gluten and sulphite.
If you have a food allergy, please notify us. Despite the careful process from ordering to serving, the allergen information mentioned in the Yummy app may differ due to cross-contamination, for example.
Delete from shopping cart
You can delete orders before making the purchase by removing scanned dishes or products from your shopping cart in the app.

Prohibited use
In addition to other terms set forth in the Terms, you are prohibited from using the App and Services: (a) for any unlawful purpose; (b) to infringe any intellectual property rights; (c) harass or discriminate against others; (d) to provide false or misleading information; (e) for any obscene or immoral purpose; or (f) to interfere with or circumvent the security features of the App and Services. We reserve the right to terminate your use of the App and Services for violation of the prohibited uses.
Intellectual property rights
Intellectual property rights are current and future rights related to copyright and related rights, trademarks, designs, patents, inventions, goodwill. These Terms do not transfer any intellectual property of Albron or third parties to you, and all rights remain with Albron. Your use of the App and Services does not grant you any right or license to reproduce or otherwise use any Albron or third party trademarks.
Limited Warranty and Limitation of Liability
To the extent permitted by applicable law, we provide the App and the Services, "as is" and "with all faults". Any use of the App and the Services is at your risk and responsibility. We make no warranties, including warranties of fitness for a particular purpose and non-infringement of intellectual property rights. Unless expressly agreed otherwise in writing, we do not guarantee that the App and the Services will be accessible at all times and without interruptions or malfunctions. Malfunctions in the App and the Services can occur as a result of malfunctions in the internet or telephone connection or due to viruses or malfunctions. We are in no way liable, or obliged to pay compensation to you, for any damage arising from or arising from the (temporary) unavailability of the App and Services or for malfunctions or failure of the App and Services. We do not warrant that the App and Services made available to you will continue to be available, will be error-free or will operate without interruption.
Disclaimer
You agree to indemnify Albron and its licensors from any liability and expense incurred in connection with or arising out of any allegations, claims, actions, or disputes that may be brought against Albron in connection with your use of the App and Services or your wilful misconduct.
Dispute settlement
Dutch law is applicable. In principle, jurisdiction lies with the court in Utrecht.
Amendments
We reserve the right to change these Terms with respect to the App and Services at any time. When we do, we will revise the updated date at the bottom of this page. We may also notify you in other ways, for example through contact details, if you have provided them.
An updated version of these Terms will be effective immediately upon posting of the revised Terms, unless otherwise noted. Your continued use of the App and Services after the effective date of the revised Terms constitutes your agreement to those changes.
